Bayside International English College Terms and Conditions

 
This is an Agreement between the student whose name appears at the end of this agreement and Bayside College Pty Ltd (trading as Bayside International English College). Once an enrolment is accepted by Bayside, the following terms and conditions become legally binding:
 
1.   Fees

Full fees must be paid before visa documents are issued and no later than 14 days before arrival. Transfers, accommodation or tuition will not be provided unless full payment has been received. The applicant acknowledges and agrees that tuition fees may change from time to time. A late payment fee of A$50 per week is payable on accounts that remain unpaid for more than 30 days after the due date notified by Bayside. Tuition fees are not transferable to other students.


2.   Courses

Bayside reserves the right to cancel any course prior to the commencement date of the course where circumstances beyond Bayside's control necessitate such changes or where the number of enrolments is not enough to operate the course viably. In such circumstances all payments received from the applicant will be refunded in full.


3.   Course entry levels

If required by Bayside, the applicant agrees to undertake a proficiency test prior course entry.


4.   Changes to enrolment

Bayside reserves the right to charge an administrative fee of $25 each time course or accommodation details are changed after a place has been confirmed.


5.   Medical

(a) In Australia it is compulsory for those on Student Visas to have Overseas Student Health Cover (OSHC). Bayside will arrange OSHC for the applicant.

(b)

Bayside is hereby authorised to obtain medical treatment for the student should such action be deemed necessary by Bayside or any staff member acting on behalf of Bayside. The student agrees to indemnify and hold harmless Bayside and its staff for any expense, loss or liability of whatever nature or however occasioned as a result of authorising and arranging such medical treatment.


6.   Giving notice of cancellation or termination

Notice of cancellation or termination must be made in writing to the Admissions Director prior to arrival.


7.   Cancellation and Refund policy

(a) Refunds are made in accordance with the policies set out below. If a student cancels his/her course or withdraws from the course after its commencement date no fees will be refunded. Any refunds payable by Bayside will be paid within 28 days. All applications for refunds must be made in writing on the Application for Refund form available from the Director and must be received by Bayside no later than 3 months after commencement of the course. Applications received after 3 months will not be processed.

(b)

Enrolment fees and accommodation booking fees are not refundable.

(c)

The following applies to Tuition fees:

- If the student is not granted a student visa - full refund (application for refund must be accompanied by a rejection letter from the Australian Embassy)
- If the student cancels more than 10 weeks prior to the commencement date of the course - full refund
- If the student cancels more than 27 days prior to the commencement of the course - 75% refund
- If the student cancels less than 28 days prior to the commencement date of the course - 50% refund
- If the student cancels after the commencement date of the course - no refund
- If the student's visa is cancelled due to the actions of the student - no refund

(d)

Unused Homestay and accommodation fees will be refunded provided at least 2 week's notice of cancellation is provided.

(e)

OSHC fees - refer to AHM.

(f)

Airport pick-up fee will be refunded in full provided notice is given to Bayside at least 24 hours prior to flight arrival.

(g)

In the unlikely event that Bayside is unable to deliver your course in full, you will be offered a refund of all the course moneys you have paid to date. The refund will be paid to you within 2 weeks of the day on which the course ceased being provided. Alternatively, you may be offered enrolment in an alternative course by Bayside at no extra cost to you. You have the right to choose whether you would prefer a full refund of course moneys paid, or to accept a place in another course. If you choose placement in another course, Bayside will ask you to sign a document to indicate that you accept the placement.
If Bayside is unable to provide a refund or place you in an alternative course our Tuition Assurance Scheme (TAS) OSTAS will place you in a suitable alternative course at no extra cost to you.
Finally, if OSTAS can not place you in a suitable alternative course, the ESOS Assurance Fund Manager will attempt to place you in a suitable alternative course or, if this is not possible, you will be eligible for a refund as calculated by the Fund Manager.

(h)

This Agreement, and the availability of complaints and appeals processes, does not remove the right of the student to take action under Australia's consumer protection laws.

(i)

Bayside reserves the right to modify any timetables, course schedules, fees and refund policy to reflect changing circumstances.


8.   Holidays

Bayside will be closed on public holidays.


9.   Resolution of disputes

In the event of a dispute between an individual student and Bayside, procedures are in place to facilitate the resolution of the dispute. Any complaint should be made first to the Director. Each complaint will be fully investigated provided it is received within one month of the completion of the course and all fees have been paid. If the student remains dissatisfied they may request the involvement of an external review panel by contacting ACPET on 1800 657 644.


10.  Liability

Bayside and its staff and representatives will not be liable for loss, damage or injury to persons or property howsoever caused, except where liability is expressly imposed by law.


11.  Student conduct

The student agrees:

(a)

to use his/her best endeavours to meet the requirements of the course in which he/she is enrolled from time to time,

(b)

to abide by the rules, policies and code of conduct advised by Bayside from time to time,

(c)

not to engage in unacceptable behaviour,

(d)

Advise Bayside and DIAC in writing within 5 days of you changing address in Australia,

(e)

to comply with student visa requirements (if applicable), in particular, attendance at at least 80% of classes and the achievement of satisfactory academic results,

(f)

to be responsible for his/her own books, equipment and personal items and hereby releases, indemnifies and holds harmless Bayside against all liability and claims for any loss or damage to such items.

Bayside reserves the right to expel any student whose conduct is unsatisfactory at the discretion of the Director whose decision is final. No fees will be refunded in such cases and any unpaid fees become immediately payable.


12.  Promotional materials

The student agrees that his/her photo, quotes and details of achievements may be used for promotional purposes without written consent or notification.


13.  Students must be 18 years of age

Bayside will not accept enrolments of students who will be under the age of 18 years at the commencement of their course.


14.  Data protection

Any information provided to Bayside may be held on computer and shall be used in accordance with its data protection registration and national data protection laws. I understand that Bayside may distribute my personal details as indicated in the statement: "Information is collected on this form and during your enrolment in order to meet our obligations under the ESOS Act and the National Code 2007; to ensure student compliance with the conditions of their visas and their obligations under Australian immigration laws generally. The authority to collect this information is contained in the Education Services for Overseas Students Act 2000, the Education Services for Overseas Students Regulations 2001 and the National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2007. Information collected about you on this form and during your enrolment can be provided, in certain circumstances, to the Australian Government and designated authorities and, if relevant, the Tuition Assurance Scheme and the ESOS Assurance Fund Manager. In other instances information collected on this form or during your enrolment can be disclosed without your consent where authorised or required by law."

Any school age dependants accompanying overseas students to Australia will be required to pay full fees if they are enrolled in either a government or non-government school.
